La “Relazione di rispondenza edilizia e conformità catastale” anche detta “RELAZIONE TECNICA INTEGRATA” è un documento introdotto in Emilia Romagna (dal 01/01/2017) ed uno simile già sussisteva da tempo anche in Toscana.

In sintesi, si tratta di una dichiarazione prodotta e firmata da un tecnico abilitato (redatta secondo un modello standardizzato ed approvato in un protocollo d’intesa) che, dopo aver visionato l’immobile ed aver acquisito la documentazione depositata al Comune sulle parti autorizzative e al Catasto, attesta che l’immobile possiede o meno la conformità edilizia e quella catastale.

Si fa presente che, pur NON ESSENDO OBBLIGATORIA (vedasi Nota dell’Autorità Garante della Concorrenza e del Mercato del 26/03/2019), la conoscenza di tale dato di conformità o di non conformità è, comunque, di fatto, fondamentale. Questo, soprattutto in termini preventivi, per poter effettuare a tempo debito la correzione, ove possibile, delle situazioni correlate ad una condizione non congruente dell’immobile e poter precedere, quindi, alla compravendita in modo da non bloccarne o sospenderne la procedura in fase di trattativa o del rogito stesso.

Tale procedura codificata, se di interesse, in termini di un check-up immobiliare preventivo, può essere effettuata IN TUTTA ITALIA SU QUALSIASI FABBRICATO CIELO-TERRA o SINGOLA UNITA’ IMMOBILIARE (appartamento) in condominio.

• LIVELLO 1 – è previsto il sopralluogo, la documentazione è fornita dal proprietario e sono previste dichiarazioni di conformità catastale ed autorizzativa ovvero di incompletezza della documentazione fornita: a partire da € 350,00 + IVA (22%)+ CNPAIA (4%) – per singola unità abitativa
• LIVELLO 2 – è previsto il sopralluogo, la documentazione è fornita dal proprietario ovvero acquisita, in toto o per integrazione, tramite Accesso agli Atti presso gli Enti competenti e sono previste dichiarazioni di conformità catastale ed autorizzativa: a partire da € 650,00 + IVA (22%)+ CNPAIA (4%)  – per singola unità abitativa

The “Report of building compliance and cadastral conformity” also known as “RELAZIONE TECNICA INTEGRATA” is a document introduced in Emilia Romagna (from 01/01/2017) and a similar one already existed for some time in Tuscany.

In brief, it is a declaration produced and signed by a qualified technician (drawn up according to a standardised model and approved in a memorandum of understanding) who, after having inspected the property and having acquired the documentation deposited at the Municipality on the authorisation parts and at the Land Registry, certifies that the property does or does not have building and land registry conformity.

It should be noted that, although it is NOT MANDATORY (see Note of the Antitrust Authority of 26/03/2019), the knowledge of this conformity or non-compliance data is, in fact, fundamental. This, above all in preventive terms, in order to be able to carry out in due time the correction, where possible, of the situations related to a non congruent condition of the property and to be able to precede, therefore, the purchase and sale in such a way as not to block or suspend the procedure during the negotiation phase or the deed itself.

Such a codified procedure, if of interest, in terms of a preventive real estate check-up, can be carried out IN ALL ITALY ON ANY BUILDING SKY-TERROR or SINGLE BUILDING UNIT (flat) in a condominium.
