Sempre più spesso in pratiche Superbonus 110% abbiamo a che fare con abitazioni dove possiamo trovare locali non abitativi che, pur essendo accatastati come tali, vengono utilizzati con fini abitativi, alle volte anche eseguendo lavori per la realizzazione di impianti termici e servizi igienici.
Cominciamo con il dire che per utilizzare questi locali a fini abitativi, bisogna eseguire un cambio di destinazione d’uso, dato che tali pertinenze modificano il carico urbanistico di tutta l’unità immobiliare.
La legge nell’ art.23-ter del D.P.R. 380/2001 si esprime a riguardo dichiarando che “Salva diversa previsione da parte delle leggi regionali, costituisce mutamento rilevante della destinazione d’uso ogni forma di utilizzo dell’immobile o della singola unità immobiliare diversa da quella originaria, ancorché non accompagnata dall’esecuzione di opere edilizie, purché tale da comportare l’assegnazione dell’immobile o dell’unità immobiliare considerati ad una diversa categoria funzionale.”
Tale mutamento è quindi da considerarsi soggetto ad un titolo abilitativo edilizio. Di conseguenza è considerato dai giudici amministrativi come un intervento di nuova costruzione che necessita di un permesso di costruire, senza il quale si incorrerebbe in reato lettera b, art.44 D.P.R. 380/2001.
In conclusione, sulla base di queste considerazioni, nella situazione descritta è possibile fare richiesta per il Superbonus unicamente tramite una preventiva sanatoria, è necessario altrimenti riportare il fabbricato allo status originario.

More and more often in 110% Superbonus practices we are dealing with dwellings where we can find non-dwelling rooms that, although stacked as such, are used for living purposes, sometimes even carrying out works for the construction of heating systems and toilets.
Let’s start by saying that in order to use these premises for residential purposes, a change of use must be made, since these appliances change the urban load of the entire property.
The law in Article 23-ter of the Presidential Decree 380/2001 expresses itself in this regard by declaring that “Unless otherwise provided by regional laws, any form of use of the property or of the single real estate unit other than the original one, even if not accompanied by the execution of building works, provided that such as to involve the assignment of the property or real estate unit considered to a different functional category. “
This change is therefore to be considered subject to a building permit. Consequently, it is considered by the administrative judges as a new construction project that requires a building permit, without which it would incur a crime letter b, Article 44 of Presidential Decree 380/2001.
In conclusion, based on these considerations, in the situation described it is possible to apply for the Superbonus only through a preventive amnesty, otherwise it is necessary to restore the building to its original status.
