PERIZIA STRAGIUDIZIALE E TESTIMONIALE DI STATO
EXTRAJUDICIAL AND TESTIMONIAL STATE EXPERTISE

Una Perizia stragiudiziale o extragiudiziale viene richiesta fuori dal processo per dirimere una questione tecnico-economica (come la stima di un bene o di un danno – ossia l’attribuzione agli stessi di un valore economico – oppure la definizione dei confini tra due terreni) o per attestare la verità riguardo ad una questione tecnica (come la conformità di un bene a specifiche norme o l’autenticità di un’opera d’arte).
Si ha una perizia asseverata se il perito ne conferma la certezza dei contenuti “sotto la propria personale responsabilità”, attestandone, con un’ulteriore dichiarazione apposta nella perizia stessa, la veridicità e rispondendo così penalmente per eventuali falsi ideologici e materiali in essa contenuti.
Si ha una perizia giurata quando la stessa, oltre alla dichiarazione che assevera la veridicità del contenuto, riporta in calce il verbale del giuramento di “aver bene e fedelmente adempiuto alle funzioni affidategli al solo scopo di far conoscere la verità”, reso dal perito dinnanzi al cancelliere di un qualsiasi ufficio giudiziario.
Un Testimoniale di stato è una perizia giurata corredata da documentazione fotografica ed eventuali elaborati grafici che riproduce fedelmente lo stato e le condizioni dei luoghi.
È utile redigerla in alcuni casi come ad esempio:
- tra le parti interessate prima di un lavoro invasivo in modo tale da conservare memoria della situazione “ante operam” e di conseguenza escludere la possibilità che danni procurati nel corso dell’esecuzione possano essere ingiustamente presentati come già esistenti a prima dell’inizio degli stessi.
- tra le parti interessate, o da una sola delle parti, prima della cessione in comodato d’uso o in locazione per un periodo lungo di tempo di un bene o di un’area al fine di riaverla restituita così come ceduta al termine del periodo.
- per “fotografare” la realtà del luogo o del singolo immobile in modo da lasciare memoria nel futuro della situazione attuale.

An extra-judicial or extra-judicial appraisal is requested outside the process to resolve a technical-economic question (such as the estimation of a good or damage – i.e. the attribution of an economic value to the same – or the definition of the boundaries between two lands) or to attest the truth regarding a technical question (such as the conformity of a good to specific norms or the authenticity of a work of art).
A sworn expert’s report is obtained if the expert confirms the certainty of the contents “under his own personal responsibility”, certifying, by means of a further declaration affixed in the report itself, the truthfulness and thus responding criminally to any false ideological and material contained in it.
A sworn expert’s report is obtained when, in addition to the declaration attesting to the truthfulness of the content, the report of the oath of “having well and faithfully performed the duties entrusted to him for the sole purpose of making the truth known”, made by the expert in front of the clerk of any judicial office, is included at the bottom of the report.
A state witness is a sworn expert’s report accompanied by photographic documentation and possible graphic works that faithfully reproduces the state and conditions of the places. It is useful to write it in some cases such as:
– to ensure that the parties concerned keep a record of the “ante operam” situation before any invasive work is carried out and, as a result, to rule out the possibility that damage caused during the execution may be unjustly presented as already existing at the beginning of the work.
– before of the transfer on loan or on lease for a long period of time of an asset or an area in order to have it returned as assigned at the end of the period.
– to have a photo of the reality of the place or individual property so as to leave a memory in the future of the current situation.
